Your Rights Under the FDCPA
In response to a long history of abusive practices and harassment on the part of debt collectors seeking to recover money owed from delinquent borrowers, Congress passed the Fair Debt Collection Practice Act in 1978. The purpose of this statute is to give legal rights to families and individuals against unfair treatment. It prohibits debt collectors and creditors from several common tactics that are intended to embarrass or intimidate a borrower into paying on a bad debt. The FDCPA contains a list of things a debt collector cannot do in pursuing payment without incurring liability under the law. Some of the most common include:
- Contacting your neighbors or co-workers about your debt in an attempt to embarrass you
- Threatening you with arrest or falsely claiming that you are about to be sued
- Calling you outside of the hours of 8:00 AM and 9:00 PM
- Persisting in contacting you after you have made a written notice that you do not wish to receive any further communication
You can not only get the assistance of the court in forcing debt collectors and creditors to stop contacting you, but you may even be awarded punitive damages by the judge. If you file Chapter 7 or
Chapter 13 bankruptcy, an automatic stay will protect you from all recovery actions by creditors, including foreclosure.
